Article 1 - General
1.1 The following conditions govern all orders placed with Ganti (hereinafter referred to as "Ganti") and apply to all purchase contracts concluded by consumers via the Ganti website (hereinafter referred to as "www.ganti.co.uk") from a distance.
1.2 By using the www.ganti.co.uk and/or placing an order, you agree to these General Terms and Conditions (hereinafter referred to as "GTC"). Please read and understand the GTC before placing an order.
1.3 Orders can only be placed by persons who are at least 18 years old, are not under guardianship, do not run a business, and have a residence in Germany or Austria.
1.4 Please note that the presentation of products or services on Ganti does not guarantee that they are available at all times. We reserve the right to withdraw products at any time.
1.5 Ganti reserves the right to change these GTC from time to time without prior notice. The version of the GTC applicable at the time of your order on the www.ganti.co.uk is binding.
Article 2 - Prices and Payment Terms
2.1 Unless otherwise stated in the product description, the prices indicated are total prices including statutory VAT. Any additional delivery and shipping costs are specified separately in the respective product description.
2.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases that the customer must bear. These include, for example, costs for bank transfers (e.g., transfer fees, exchange rate fees) or import duties and taxes. Such costs may also arise if the payment is not made from a country outside the European Union, but the customer makes the payment from such a country.
2.3 The accepted payment methods are communicated to the customer in the Ganti online shop: PayPal, Visa, Mastercard, Apple Pay, Google Pay, Shop Pay.
Article 3 - Order
3.1 You have the option to place orders on the www.ganti.co.uk.
3.2 After placing an order, you will receive a confirmation by email. In the unlikely event that we are unable to fulfill your order, we will notify you immediately. If your order has already been paid for, we will attempt to refund the payment via the payment method you used. If a refund is required by other means, Ganti will inform you and ask you to contact customer service to process the refund.
Article 4 - Delivery
4.1 The ordered goods will be delivered to the delivery address specified by the customer, unless otherwise agreed. In the context of order processing, the delivery address specified in the Ganti order process is decisive. When using the PayPal payment method, the delivery address stored by the customer with PayPal at the time of payment is decisive.
4.2 If the carrier returns the shipped goods to Ganti because delivery to the customer was not possible, the customer bears the costs of the unsuccessful delivery. This does not apply if the customer is not responsible for the circumstance that led to the impossibility of delivery or if the customer was temporarily prevented from accepting the service, unless Ganti has announced the service in an appropriate manner in advance. This also applies to the costs of delivery if the customer effectively exercises their statutory right of withdrawal. If the customer exercises their right of withdrawal, the provisions described in Ganti's shipping policy regarding return costs apply.
4.3 Collection of the goods by the customer is not possible for logistical reasons.
Article 5 - Cancellation of an Order
Since we process your order immediately, it is unfortunately not possible to cancel your order. However, it is possible to return your order within 30 days of receipt. Article 6 - Returns
To report a return, please send an email to www.ganti.co.uk. Return the items within 30 days. We strive to refund the money within 3 to 5 business days, using the same payment method you used for your order. If an item is faulty, please email us immediately at www.ganti.co.uk. The return shipping costs are borne by the buyer. For more information on our return process, please refer to our return policy.
Article 7 - Our Liability
7.1 If there is a defect in the purchased item, the statutory warranty applies.
7.2 For used goods, the following applies: Claims for defects are excluded if the defect occurs only 30 days after delivery of the goods. Defects that occur within 30 days of delivery of the goods can be asserted.
7.3 The customer is requested to report any obvious transport damage to the delivery agent and inform the seller. If the customer fails to do so, their legal or contractual claims for defects remain unaffected.
Article 8 - Redeeming Promotional Vouchers
8.1 Promotional vouchers, which are offered free of charge as part of promotions with a specific validity period and cannot be purchased (hereinafter referred to as "promotional vouchers"), can only be redeemed in the seller's online shop and only within the specified period.
8.2 Promotional vouchers can only be redeemed by consumers.
8.3 Individual products may be excluded from the voucher promotion if the promotional voucher contains corresponding restrictions.
8.4 Promotional vouchers can only be redeemed before completing the order process. A subsequent offsetting is not possible.
8.5 Only one promotional voucher can be redeemed per order.
8.6 The value of the ordered goods must at least correspond to the value of the promotional voucher. Any remaining balance will not be refunded.
8.7 If the value of the promotional voucher is not sufficient to cover the order, the customer can choose one of the other payment methods offered by the seller to pay the difference.
8.8 The credit of a promotional voucher is neither paid out in cash nor interest-bearing.
8.9 The promotional voucher will not be refunded if the customer returns the goods paid for with the voucher in accordance with their statutory right of withdrawal.
8.10 The promotional voucher is intended only for the named holder and cannot be transferred to third parties. The seller is entitled but not obliged to check the eligibility of the voucher holder.
Article 9 - Applicable Law
All legal relationships between the parties are governed by the law of the United Kingdom, excluding the provisions on the international sale of movable goods. This choice of law applies to consumers only insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.
Article 10 - Alternative Dispute Resolution
10.1 The European Union provides a platform for online dispute resolution on the internet at the link https://ec.europa.eu/consumers/odr. This platform serves as a point of contact for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.
10.2 The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
Article 11 - CESOP
Due to the measures introduced and tightened from 2024 with regard to the 'Act amending the Value Added Tax Act 1968 (Payment Service Providers Directive Implementation Act)' and thus the introduction of the Central Electronic Payment Information System (CESOP), payment service providers could register data in the European CESOP system.
